AIE is the management entity for the rights of performers

If you wish to legalize the public use of music in your own establishments or venues, AIE enables you to enforce the relevant contract certifying your compliance with the current legislation.

AIE helps businesses to benefit from the value of music and the profits earned through the public use and dissemination of recorded music with full legal guarantees, and, at the same time, protects the rights of performers derived from the use of their musical works.

AIE, periodically audited by private companies and public bodies, ensures the effective management of performers rights and provides the users of music (businesses making public use of recorded music) with the relevant contract to legalize and regulate the conditions for the public communication of recorded music as provided by law. Furthermore, AIE manages the income collected (legally recognized) and distributes it equitably among its right holders, performers and executants.

Extrajudicial conflict resolution

With a view to implementing the quality standards present in several management areas of the entity, AIE establishes a series of collection and commercial management processes integrated at various stages of its activity for the purpose of carrying out the management conferred by AIE members and upon the Law on Intellectual Property with transparency and efficiency.

These stages of the collection and users management processes are based on solid economic studies and legal foundations whose ultimate object is to reach a consensus with the users of intellectual property rights managed by AIE.

  1. i) Regulation of rights.

After identifying those users that carry out any act of exploitation of any of the rights managed by AIE, the Users Management Department will contact them by any means available (phone, email, post…) to clarify which rights are managed by AIE and which procedures are necessary to regulate their use.
All necessary documents and relevant information will be available to all users with the aim to negotiate the amount corresponding to the rights derived from the services provided by the user and which include any musical interpretation or performance fixed in a phonogram or audio visual recording.

  1. ii) Extrajudicial conflict resolution.

Moreover, AIE is always committed to searching alternatives to court litigation whenever the formalization of a friendly and voluntary regulation process with the user is not possible. Therefore, the following means of extrajudicial conflict resolution are proposed:

  • Civil settlement before the Courts of First Instance where the defendant is domiciled.
  • Mediation before the Committee on Intellectual Property (or any other eligible body designated by both parties).
  • Arbitration before the Committee on Intellectual Property (or any other eligible body designated by both parties).

Which steps should be followed to legalize the use of music?

Find below the necessary steps to legalize the use, public communication and dissemination of music in your business:

  1. Select your user profile.

First of all, select your business profile (bar, hotel, night club, collective transport, etc.) and the type of musical contents delivered to the public in your business. On the basis of this information, you will be able to identify whether your business activities generate any type of rights recognized by law to performers and derived from the public use of their musical works.   1. Consult the tariffs and the model contract applicable to your business.

  1. Send all additional documents required.

To establish a contractual relationship with AIE, depending on the model contract applicable to your business, AIE may request you to provide the relevant additional documents required for the formalization of the contract (monthly statements, use reports, etc.) in accordance with AIE regulations.
