What is Intellectual Property?

It refers to the set of rights that belong to artists, authors, and other rights holders (producers, broadcasting organizations, etc.) regarding their performances, works, recordings, and other outputs resulting from their creations. 

What is AIE?

AIE is the international organization that defends and manages the rights of performing and executant artists in music for the use of their repertoire in all countries and regions worldwide where intellectual property rights are regulated and compensated.

Non-profit, AIE was created by and for musical artists and has been efficiently managing their rights globally for over 30 years. It has a specialized management team and state-of-the-art tools, allowing it to maximize artists’ earnings worldwide.

Who are considered performers and executants?

Performers are those who, in a significant way, represent, sing, read, recite, or interpret, in any form, a literary or artistic work, a phonogram, an audiovisual recording, a folkloric expression, or any other act subject to rights. Soloists and orchestra conductors are included in this group.

Executants are those who accompany one or more performers by representing, singing, reading, reciting, declaiming, or performing a literary or artistic work, a phonogram, an audiovisual recording, a folkloric expression, or any other act subject to rights. Members of orchestras or choirs fall into this category.

Can I join AIE if I already belong to an authors' management society?

Absolutely. The rights managed by AIE are entirely independent, compatible, and cumulative with copyrights (DAMA, SGAE, BMI, ASCAP…) and are additional to any royalties an artist may receive under a record label agreement.

What rights does AIE collect in Spain?

AIE collects the following rights for its members:

  • Public Communication: Derived from the broadcasting or transmission of a work or song through radios, televisions, and other music users. This right is widely recognized internationally.
        • Public Performance: A subset of Public Communication, covering the broadcasting of fixed performances in public venues like bars, nightclubs, restaurants, hotels, transportation, gyms, etc.
  • Private Copy: Compensation for artists for the revenue and rights they lose due to copies made in private environments. In this case, manufacturers and importers of devices (smartphones, tablets, computers, etc.) where such copies can be made are responsible for payments.
  • Making Available: A form of Public Communication where listeners can choose what to listen to or watch, from any device, at their chosen time. Examples include on-demand streaming platforms for audio and video. 
Does AIE collect rights globally?

Yes, in addition to collecting for the use of your music in Spain, AIE has 109 reciprocity agreements with 81 similar organizations in 58 countries, exchanging rights generated by the use of your music internationally.

Does AIE collect for live performances?

No, AIE does not collect for concerts or shows because the law requires songs to be fixed on a medium (audio or video), like a CD or a television program. For concerts, it is understood that the artist’s fee already covers performing rights.

However, if a published phonogram is used in a commercial show, AIE will manage the license with the event promoter or venue to enforce the public communication remuneration rights.

Can I be an AIE member without living in Spain?

AIE operates internationally, so your location does not matter as long as you are a performer or executant artist.

How do I join AIE?

The process is simple and free. You can apply online at https://altasocios.aie.es/login or in person at one of AIE’s offices in Madrid, Barcelona, or Seville.

What benefits does being an AIE member provide?

Through its Social and Cultural Fund (FONACAIE), AIE offers national and international support for artist promotion, scholarships, and training courses. 

Additionally, AIE provides a range of services to help artists at different stages of their careers and to support their professional activities securely.

How does AIE track my repertoire once I join?

AIE is a declarative society where members must inform about their repertoire. The process is simple and can be done through the Virtual Office: https://oficinavirtual.aie.es/Login. AIE also proactively works to identify unreported repertoire through other means.

When will I receive my first payment?

Like most management societies, AIE distributes rights with an approximate nine-month delay. This means the music currently generating rights will be paid out the following year.

Distributions occur quarterly, starting in January. The schedule is available at: https://www.aie.es/socios/ventajas-de-ser-socio/

Additionally, if rights were generated in the past five years for a track you participated in, you will receive any accumulated amounts since they are not time-barred.

How can I track my activity with AIE?

As a member, you will receive a username and password to access the Virtual Office, where you can manage your personal information, financial data, and repertoire. You can also update your account, declare new repertoire, or review invoices. Access it here: https://oficinavirtual.aie.es/Login.

Why haven't I received any payment from AIE?

If you have not received payment after the last distribution, it may be due to:

  • Your song is not in our usage data or has not been played enough to generate rights.
  • We have not yet collected the generated rights from radios, televisions, bars, clubs, or streaming platforms.
  • Your songs haven’t reached the minimum amount for distribution. AIE requires a minimum of €30 per right managed to process payments. Below this, amounts accumulate until they meet this threshold.
  • Your song(s) are undeclared. AIE may have identified a track or another party might have registered it, but you haven’t confirmed your participation.
